Welcome to Lyn's Tanks. By accessing our website, placing an order, or using our services, you agree to these Terms of Service ("Terms"). Please read them carefully, as they form a binding agreement between you and Lyn's Tanks.
1. General conditions
By placing an order, you confirm that you are at least 18 years old, that the information you provide is accurate and complete, and that you are an authorised user of the payment method used. We reserve the right to refuse or cancel any order, or to refuse service, where we reasonably suspect fraud, unauthorised payment, or a breach of these Terms.
2. Products and pricing
We aim to describe and price every product accurately. Prices, descriptions, and availability may change at any time without notice. In the event of an obvious pricing or description error, we reserve the right to cancel the affected order and issue a full refund, even after an order confirmation has been sent.
3. Payments and authorisation
All payments are processed through trusted, secure providers, and we do not store your full payment details. By submitting an order and providing a payment method, you authorise us to charge the full order amount, including any applicable shipping and taxes, to that payment method. You confirm that you are the account holder or have explicit permission to use it. Submitting an order constitutes a firm commitment to purchase.
4. Order acceptance and cancellation
Your order is an offer to buy, and a contract is formed once we send your dispatch confirmation. Orders may be cancelled within the window and on the conditions set out in our Order Cancellation policy, which forms part of these Terms. After that window, orders enter fulfilment and can no longer be cancelled or changed.
5. Shipping, delivery, and risk
Delivery timeframes are estimates and are not guaranteed. You are responsible for entering a correct and complete shipping address at checkout. Responsibility for the order passes to you once it is delivered to the address you provided, or once tracking confirms delivery to that address, at which point the order is considered fulfilled.Â
6. Returns and refunds
Returns and refunds are handled in accordance with our Returns, Refunds, and 30-Day Perfect Fit Guarantee policies, each of which forms part of these Terms. Returns must be approved by us before any item is sent back, and refunds, where approved, are issued to the original payment method only.
7. Disputes and chargebacks
If you have any concern about an order, a charge, or a delivery, please contact us first at info@lyn-tanks.co.nz so we can resolve it directly. We respond to every enquiry within the day and resolve most issues in a single email. By agreeing to these Terms, you agree to raise any billing concern with us before initiating a chargeback or payment dispute. Initiating a chargeback for an order that was delivered as described, or that falls outside the terms of our published policies, may be treated as a breach of these Terms, and we reserve the right to submit our records, including order, delivery, tracking, and communication history, in response.
8. Limitation of liability
To the fullest extent permitted by law, Lyn's Tanks is not liable for any indirect, incidental, or consequential loss arising from the use of our products or website. Our total liability in connection with any order is limited to the amount you paid for that order.Â
9. Governing law
These Terms are governed by the laws of New Zealand. Any disputes will be handled respectfully and in the spirit of finding the best resolution for you.
10. Amendments
We may update these Terms from time to time. Changes take effect as soon as they are posted, and the "last updated" date above will reflect the most recent version. Your continued use of the site after changes are posted constitutes acceptance of the updated Terms.
